The Conduit team is committed to making our website accessible to individuals with disabilities. In this effort, we aim to follow Web Content Accessibility Guidelines (WCAG). We incorporate accessibility testing in the design, development and maintenance of Conduit.org. Conduit is a resource that facilitates information sharing, coordination​, and collaboration among Energy Efficiency professionals in the Northwest. To foster a collaborative environment where quality information and insight is shared, please review the following:

Community Overview

Conduit provides open, publicly accessible forums and communication tools for Northwest energy efficiency professionals to learn, share, and discuss practical solutions to implementation activities with each other, industry experts, and experts at government agencies. By registering as a member of Conduit, users may post to forums, blogs, and use other online resources for sharing information with other members. They may also share information about themselves and their organizations in their user profile.  These member-contributed resources and user profiles are moderated by the Conduit Community team, which includes NEEA staff and contractors.

Terms and Conditions

These Terms and Conditions constitute an agreement (the “Agreement”) between you ( “You”) and the Northwest Energy Efficiency Alliance (“NEEA”) under which You may use the Conduit web site located at www.conduitnw.org and all content available therein, including, but not limited to, its forums, blogs and tools (“Conduit”).  By using Conduit You accept and agree to be bound to the following terms and conditions whether or not You register as a member of Conduit.

Term and Termination

This Agreement shall remain in full force and effect while you use Conduit, and/or are a member of Conduit. You may terminate your membership at any time, for any reason by following the instructions on Conduit.

Rules of Conduct

You agree to abide by the “Rules of Conduct” and Community Best Practices incorporated into this Agreement. Any contribution that does not meet these rules of conduct and Community Best Practices may be removed.

  1. Comments and contributions to forum threads or blog posts should be descriptive, succinct, and relevant to discussion or forum topic.
  2. To better facilitate conversation, moderators may move off-topic threads to another appropriate forum, close threads or delete off-topic posts at their discretion.
  3. To maintain quality of discussions, contributions that do not provide a substantive purpose or relevance may be flagged by a moderator as abuse, and will be removed.
  4. We encourage community members to have open and candid discussions and debates. We will not censor members for expressing an opinion within the limits of these Rules of Conduct.  However, all communications should be civil and polite. Community members should treat each other with respect and consideration for all points of view. Please remember that this is a public venue read by many people of all ages, spanning all walks of life, representing private and public entities, including the media. We recommend behaving in the same way that You would in a public meeting.  What You say or do could be taken out of context.
  5. You may not post, transmit or provide hyperlinks or pointers to material that is knowingly false and/or defamatory; contain ad hominem attacks, misleading, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening or invasive of a person's privacy; that otherwise violates any law; or that encourages conduct constituting a criminal offense.
  6. You are encouraged to discuss and share business knowledge and experiences.  To ensure that all users will get the most out of Conduit, the following linking policies are in effect to curb self-promotion and spam.  Posts that do not adhere to these policies may have their links disabled or be removed.
    1. You may not use Conduit to post, transmit or provide hyperlinks or pointers to content that promote Your business, product or service or does not address the thread's topic.
    2. You may link to Federal, state, or local government websites for the purpose of sharing verified information.
    3. You may use Your profile page to share information about Your business, products, or services, and may include only one (1) hyperlink to Your commercial website.
    4. You may include only one (1) link in Your signature line.   Any additional links to websites, social network profiles, or email addresses will be removed.
  7. User names that might be deemed abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, invasive of a person's privacy, or otherwise inappropriate are not allowed and will be removed.  This also applies to email addresses, tags, and profile information.
  8. User names that are intended to mislead others will be removed. Such nicknames include but are not limited to using nicknames that impersonate competitors, other community members, government employees, elected officials, or any other individual or entity.
  9. You may not use Conduit to engage in lobbying or political activities, including, but not limited to, requesting or promoting legislative action or communication with legislators or legislative bodies.
  10. Sock puppet accounts are not permitted. A sock puppet is an account made on an Internet message board by a person who already has an account for the purpose of posting anonymously or as a different user. Posts from known sock puppet accounts will result in deletion of the posts and sock puppet accounts.
  11. Email excerpts of any type or length are not allowed to be posted in Conduit.
  12. To protect the privacy of community members, and the privacy of others, You may not include anyone's personal information or personally identifiable information such as home addresses, phone numbers, or social security numbers in any forum, blog, or other member contributed area. By default, personal information You choose to include in Your user profile can be viewed by Conduit members. A minimum amount of information is required. You may provide additional information to complete your profile.
  13. Advertising: You may not use Conduit to advertise or promote businesses, products or services within the discussion boards, idea exchanges or blogs. Posts that contain pricing information will be considered abuse and removed.  Community members may use their profile page to share information about themselves, their businesses, products, services and personal and professional background.
  14. Intellectual property: You may not use Conduit to post material that is protected by copyright, trademark or other proprietary right without the express permission of the owner(s) of said copyright, trademark or other proprietary right. Subject to federal law, government-produced materials appearing on Conduit are not copyright protected. Once posted on Conduit, blog posts, including guest blog posts, are considered public domain.
  15. Spam: Posting the same message, or an unsolicited commercial message, to one or many topics or boards is considered spam and will be removed. Duplicate messages may be deleted or consolidated by a Moderator.
  16. Access Permissions:  Certain portions of Conduit are limited to registered users and/or certain groups of registered users. As a term of registration, You agree that any information provided to us will be complete and accurate, that You will not register under the name of, nor attempt to enter the site under the name of, another person, and that You will not adopt a user name that Conduit, in its sole discretion, deems offensive.
  17. Abusive and harassing behavior or any actions that violate these Rules of Conduct may result in suspension or termination of Your ability to post to forums and other member-contributed areas. Account suspensions may be appealed to a Moderator.
  18. Private discussions: Sometimes, a discussion thread strays off into a friendly dialogue or a heated debate among a very small number of users. For these exchanges, we ask that You take these discussions outside Conduit.

User Profiles

You may create personalized profiles about Yourself. By default any information You supply about Yourself is viewable by all registered users of Conduit. The content of personal profiles are subject to the same Rules of Conduct as the forums, blogs and other member-contributed content. 

Guest Contributors

Occasionally, NEEA will invite guest bloggers from industry and government to contribute their expertise.   Please read the disclaimer below concerning the views expressed in contributions from guest contributors.

Modification of Service

The Conduit Community is moderated by NEEA, and its contractors. We recognize that the internet is a 24/7 medium, and Your comments are welcome at any time. You acknowledge that NEEA does not pre-screen, control, edit or endorse content made available through Conduit and has no obligation to monitor the content made available via Conduit. If NEEA discovers content that does not appear to conform to this Agreement, NEEA may investigate and determine in good faith and in its sole discretion whether or not to remove or modify the content. NEEA is under no obligation to do so and NEEA will have no liability or responsibility for performance or non-performance of such activities. You agree to resolve directly and exclusively with third parties any disputes You may have about messages that they post. You may also submit a comment to request a removal.

You agree that NEEA may, in its sole discretion, at any time terminate Your password, account (or any part of it) or ability to use Conduit, temporarily or permanently, and modify or remove and discard any content posted by You within Conduit, for any reason or for no reason. You agree that any termination of Your access to Conduit may be immediate and without prior notice. You further agree that NEEA shall not be liable to You or any third-party for any termination of Your use or ability to access Conduit.

Privacy Policy 

The privacy of users and members of Conduit is very important.  Conduit’s privacy policy is located at http://conduit.axian.com/pages/privacy.aspx and is incorporated into this Agreement.

Copyright Information 

Except where otherwise noted, third-party content on this site is licensed under a Creative Commons Attribution 3.0 License. Registered members of this website agree to grant a non-exclusive, irrevocable, royalty-free license to the rest of the world for their submissions to Conduit, licensed under the Creative Commons Attribution 3.0 License

When using Conduit You may encounter documents, illustrations, photographs, or other information resources contributed or licensed by private individuals, companies, or organizations that may be protected by U.S. and foreign copyright laws. Transmission or reproduction of protected items beyond that allowed by fair use as defined in the copyright laws requires the written permission of the copyright owners. It is Your responsibility to identify the copyright owner and obtain permission before making use of this material.

Pursuant to federal law, government-produced materials appearing on Conduit are not copyright protected.

Digital Millennium Copyright Act (DMCA) Notice

Conduit respects the intellectual property of others, and we ask users of our websites to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable law, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, subscribers or account holders who are deemed to be repeat infringers. We may also at our sole discretion limit access to our Web site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Privacy Policy

Conduit collects the minimum information necessary to create a community of users when You visit our website unless You choose to provide additional information to us. If You choose to provide this information to us, it will be used for the expressed purpose for which it was intended, the operation of the Conduit Community. We will not share our list with other organizations or sell our list for marketing purposes.

Conduit collects some technical information from You when You visit the site in order to give You the best possible experience and to measure activity on the Conduit Community such as number of users, number of user posts, number of posts read, etc. The section below explains how we handle and collect technical information when You visit our website.

Technical Information Collected and Stored Automatically

Conduit automatically records anonymous website usage information that we analyze statistically to track operational problems, to prevent fraud and to improve the effectiveness, security and integrity of the site. This information does not identify You personally and we do not use this information to track or record information about individuals. For each page that You visit, we collect and store only the following technical information:

  • Date and time of access
  • URL address of the Conduit webpage visited
  • Internet domain and IP address from which our website was accessed
  • Type of browser and operating system used to access our site (if provided by the browser)
  • URL address of the referring page (if provided by the browser)
  • Completion or success status of the request for a web page or other on-line item
  • File size of the webpage visited
This information is only used to help us make the site more useful for You. With this data we learn about the number of visitors to our site and the types of technology our visitors use.

Cookies

When You visit some websites, their web servers generate files of information known as cookies, which helps webmasters understand how users interact with their site's content and services. Websites use cookies to track one's activities on a website (e.g., pages visited, links clicked on, etc.), and to record information about the user so when the user returns the site, customized features can be provided.

There are two types of cookies. A session cookie is a line of text that is stored temporarily in Your computer's random access memory (RAM) and is only available for the duration of an active browsing session. A session cookie is not placed on any hard drive, and it is destroyed as soon as You close Your browser. Some of the interactive sections of Conduit may set session cookies in temporary memory in order to provide streamlined navigation. Information from these session cookies is not collected or saved.

By default, Conduit does not use persistent cookies. However, through the user’s profile page, users may elect to utilize persistent cookies to automate log-in. 

Children's Privacy

Because we care about the safety and privacy of children online, we comply with the Children's Online Privacy Protection Act of 1998 (COPPA). COPPA and its accompanying FTC regulation establish United States federal law that protects the privacy of children using the Internet. Conduit does not knowingly contact or collect personal information from children under 13. Conduit is not intended to solicit information of any kind from children under 13.

It is possible that by fraud or deception we may receive information pertaining to children under 13. If we are notified of this, as soon as we verify the information, we will immediately obtain parental consent or otherwise delete the information from our servers. If You want to notify us of our receipt of information by children under 13, please contact us.

Information Collected from Interactive Forms

Conduit provides interactive forms that let You voluntarily submit personal information via Your user profile, such as Your username, e-mail address, name, or organization. This occurs when You submit information to web discussion forums, blogs and other community features; and sending questions and comments to the Conduit support team. In these cases, all submitted information is used only for the express purposes for which it is intended, and is not made available to any third party. Conduit never collects information or creates individual profiles for commercial marketing. However, when You join an online community and participate in online discussions, Your name and other personal information You provide are viewable by any registered user of Conduit.

Site Security

For site security purposes and to ensure that this service remains available to all users, this computer system employs commercial software programs to monitor network traffic to identify unauthorized attempts to upload or change information, or otherwise cause damage.

Unauthorized attempts to upload information or change information on this service are strictly prohibited and may be punishable under the Computer Fraud and Abuse Act of 1986 and the National Information Infrastructure Protection Act.

Links to Other Sites

Conduit contains links to websites of other government, public and private organizations that are outside of our control. When You follow a link to another site, You leave the Conduit site and Your website interactions are no longer protected by our privacy policy. Conduit is not responsible for, and does not endorse the privacy or security practices and content of sites to which Conduit links.

IRS Circular 230

Any discussion of U.S. tax matters contained in Conduit is not intended or written to be used, and cannot be used, for the purpose of (i) avoiding penalties under the Internal Revenue Code or (ii) promoting, marketing or recommending to another party any transaction or other matter.

Disclaimer of Warranties 

Except when specifically noted, any views or opinions expressed on Conduit, its forums, blogs or member-contributed resources, are those of the individual contributors. The views and posted comments do not necessarily reflect those of NEEA, or its contractors.

Indemnity

You agree to defend, indemnify and hold each of NEEA, its directors, officers, employees, and agents harmless from any and all claims, demands, suits, losses, costs, and damages of every kind and description, including reasonable attorney fees arising out of, or in any way connected with use of Conduit and/or in violation of this Agreement by You and/or any users of Your Conduit account, including, without limitation, any breach of the representations and warranties made by You herein, any and all claims arising from content or other materials posted onto the Conduit by You, or the infringement by You, or any other user of Your account, of any Proprietary Rights or other rights of any person or entity.

Notice for California Users

As required by California Code Section 1789.3, this notice is to advise you of the following: Conduit is provided by NEEA (www.neea.org). General

This Agreement constitutes the entire agreement between You and NEEA and governs Your use of Conduit, and supersedes all prior agreements between You and NEEA with respect to Conduit.

Headings used in this Agreement are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section or in any way affect this Agreement. All provisions of this Agreement that by their terms extend beyond the termination of use of Conduit or this Agreement shall survive such termination and remain in full force and effect.

This Contract shall be interpreted, construed and enforced in all respects in accordance with the substantive and procedural laws of the State of Oregon without regard to the choice or conflicts of law provisions of any jurisdiction, and any disputes, actions, claims or causes of action arising out of or in connection with this Agreement or Conduit shall be subject to the exclusive jurisdiction of the Multnomah County Circuit Court or the United States District Court in Portland, Oregon.

The failure of NEEA to exercise or enforce any right or provision of the Agreement shall not constitute a waiver of such right or provision. If any provision of the Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Agreement shall remain in full force and effect.

Changes to this Agreement

NEEA reserves the right to revise or update this Agreement at any time and from time to time. You should refer back to this page often for the latest information and the effective date of any changes. If NEEA decides to change this Agreement, NEEA will change the date at the bottom. NEEA shall have no obligation to notify You of any such changes other than posting such modifications on Conduit, but NEEA reserves the right, in its sole discretion, to provide You notice of such changes to any e-mail address You have provided to NEEA, or the mailing address you have provided to NEEA.
